What’s a probate?
When a person dies owning property in Oklahoma, their Estate may need a probate in Oklahoma. This process usually takes place in a District Court in Oklahoma. There are many reasons for probating a person’s Estate. These can include determining the heirs of the deceased as well as giving their assets (money, house, car, etc) to their loved ones.
You should talk to a probate attorney when you are faced with the probate of a loved one’s Estate. Your probate attorney will suggest one of three main routes for the probate of your loved one’s Estate in Oklahoma. Those three are Traditional Probate, Ancillary Probate, and Summary Administration.
Three Types of Probate in Oklahoma
Ancillary Probate is the fastest way to probate in Oklahoma. But, is only available if a person dies in another state and their Estate was ALREADY probated in their “home” state. Typically this type of probate is used when your loved one owned “real property” in Oklahoma. “Real property” includes mineral rights in Oklahoma.
Summary Administration is a type of probate that is faster than “Traditional Probate”. This type of probate in Oklahoma might be an option if your loved one:
- lived in a state other than Oklahoma,
- owned property worth less than $200,000.00, or
- has been deceased for more than 5 years.
We do a lot of summary administration probates in Oklahoma for mineral interests. If your loved one owned mineral interests in Oklahoma this type of probate may work the best.
Traditional Probate is the last option, and will be selected if factors favor this process over the other options. For example, if you need to sell your loved one’s home during the probate process, it may be better to do Traditional Probate.
