What is Estate Planning?

Estate Planning is the plan you make while you are living that takes care of you and your family in case of disability or death. An Estate Planning Attorney can help make an Estate Plan that suits your needs.

If you are wondering if you need an Estate Plan, the answer is probably YES.  In fact, an Estate Plan is beneficial for nearly everyone at every income level.

Your Estate Plan can be simple or complex, depending on your specific situation. Additionally, your plan may grow and change as you age, your family changes, and you acquire different assets. But you should have one at every age. Are you curious if Estate Planning would benefit you? We’d be happy to chat, book a consultation.

What does an Estate Plan do?

An Estate Planning Attorney can help develop a comprehensive Estate Plan. A good Estate plan will do the following:

  • Pass your personal and real property to the next generation
  • Name a guardian for minor children
  • Protect loved ones from bad decision-making
  • Provide for special needs family members
  • Minimize taxes, court fees, and unnecessary costs
  • Say who will take care of you if you are ill or incapacitated

Is an Estate Plan the same for everyone?

Depending on each client’s needs, Estate Planning can mean different things. Consequently, our Estate Planning Attorneys focus on the issues that matter most to you. Once we determine those issues, we will develop an Estate Plan tailored for you. For example, if you have young children, you need to plan who will care for them if something happens to you. Or perhaps you are wondering how to navigate leaving different assets to someone with special needs, your siblings, or your favorite charity. These are all common issues we can help resolve without added pressure or stress. Further, we are here to help ensure you have an Estate Plan that reflects what YOU want.

Will Estate Planning take a lot of time?

A common worry is that Estate Planning will take up too much of your time. Certainly, we DO need some information from you to do your Estate Plan.  But, our years of experience have allowed us to streamline the process. In fact, our clients tell us that they spend around fifteen minutes to an hour filling out our initial questionnaire. Generally, you will need to tell us your address and information about the loved ones you would like included in your plan. However, we take it from there and do the heavy lifting. And, of course, you will have time along the way to ask as few or as many questions as you have.

What happens if you don't do an Estate Plan?

If you don’t do an Estate Plan, your loved ones may have to open a Guardianship to take care of you if you become incapacitated. Also, your loved ones may have to hire an attorney and open probate to give your things away to your heirs. Finally, the government will get to decide who will get your property.
